Phone Call Integration Terms and Conditions

These Phone Call Integration Terms and Conditions ("Call Terms") govern your access to and use of Persona's phone call integration feature ("Call Integration") and are incorporated by reference into, and form part of, Persona's Terms of Service ("Agreement"). Capitalized terms not otherwise defined herein have the meanings assigned to them in the Agreement.

By enabling, accessing, or using the Call Integration, you acknowledge that you have read, understood, and agree to be bound by these Call Terms, the Agreement, and our Privacy Policy. If you do not agree, you may not use the Call Integration.

1. Call Recording and Consent

(a) Recording and Transcription

Persona may record, store, and transcribe audio from phone calls made through the Call Integration for the purposes of providing, maintaining, analyzing, and improving the Service, including quality assurance, training of automated systems, and compliance monitoring.

(b) Consent Requirements

By initiating or participating in a call through the Call Integration, you represent and warrant that you have obtained all necessary consents and provided all legally required notices to any and all participants in the call regarding such recording and transcription. You agree that Persona shall not be responsible for obtaining consent on your behalf.

(c) Use of Recordings

Call recordings and transcriptions constitute "User Data" under the Agreement and will be handled in accordance with our Privacy Policy. Persona may anonymize and aggregate such data for internal analysis, system improvement, and diagnostic purposes, provided that no personally identifiable information is disclosed.

2. Relationship to Terms of Service and Privacy Policy

Your use of the Call Integration remains subject to the full terms of the Agreement and our Privacy Policy. These Call Terms supplement, and do not limit, any other rights, obligations, disclaimers, or limitations contained therein. In the event of any conflict between these Call Terms and the Agreement, these Call Terms will control solely with respect to the Call Integration.

3. Fees, Billing, and Overage Charges

(a) Included Minutes

Your subscription plan includes a specific allotment of phone call minutes as set forth in your plan details.

(b) Overage Charges

Once your usage exceeds the allotted number of minutes under your plan, Persona will automatically bill you for additional usage on a per-minute basis at the then-current overage rate. Overage rates may vary by plan and are subject to change with prior notice as provided in the Agreement.

(c) Authorization to Charge

You authorize Persona (or its third-party payment processor) to automatically charge your designated payment method for any applicable overage fees, taxes, and other charges incurred in connection with your use of the Call Integration.

(d) Billing Disputes

Any dispute regarding billing must be submitted in writing within thirty (30) days of the charge. Failure to do so constitutes a waiver of any claim related to such charges.

4. Compliance and Lawful Use

You agree to use the Call Integration only for lawful purposes and in compliance with all applicable laws, including without limitation those governing call recording, privacy, data protection, and telecommunication. Persona reserves the right to suspend or terminate access to the Call Integration if it reasonably believes that your use violates applicable law or the Agreement.

5. Limitation of Liability

To the maximum extent permitted by law, Persona disclaims all liability arising from or related to your use of the Call Integration, including without limitation liability for (a) failure to obtain or communicate consent from call participants, (b) inadvertent disclosure of information, (c) data loss, corruption, or unauthorized access to recordings or transcripts, and (d) any telecommunication charges or fees imposed by third parties.

6. Modifications

Persona reserves the right to modify, suspend, or discontinue the Call Integration at any time, and to amend these Call Terms by posting an updated version. Continued use of the Call Integration following such notice constitutes acceptance of the revised terms.
